Metrix Holdings LLC dba eQuoto (“eQuoto,” “we,” “us,” or “our”) operates IntroCart.

This Privacy Policy describes how we collect, use, disclose, and otherwise process personal information in connection with IntroCart.

Depending upon how you interact with IntroCart, we may collect:

Account and identity information, including name, business name, email address, telephone number, mailing address, username, and account credentials.

Business information, including agency or company information, licensing information, job title, business type, and regulatory information.

Transaction information, including purchases, account balances, credits, invoices, payment status, products purchased, and transaction history.

Payment information. Payments may be processed by third-party payment processors. We may receive transaction identifiers, payment status, billing information, and limited payment-method information, but payment processors may directly collect full card or banking information.

Device and usage information, including IP address, browser type, device information, login activity, Platform interactions, referring URLs, cookies, and similar technologies.

Communications, including support requests, emails, credit requests, complaints, and other communications with us.

Compliance information, including licensing records, verification information, consumer complaints, suppression requests, and records reasonably necessary for fraud prevention or legal compliance.

2. How We Use Information

We may use information to:

• create and administer IntroCart accounts;

• authenticate Users and maintain Platform security;

• process purchases and account credits;

• deliver Leads and provide Platform functionality;

• provide customer support;

• maintain transaction and acceptance records;

• prevent fraud, abuse, and unauthorized activity;

• evaluate and improve IntroCart;

• communicate regarding accounts, transactions, products, and services;

• investigate complaints and disputes;

• comply with legal and regulatory requirements; and

• establish, exercise, or defend legal rights.

3. How We Disclose Information

We may disclose personal information to service providers and vendors supporting our business, including payment processors, hosting providers, security vendors, analytics providers, communications providers, professional advisers, and other technology providers.

We may also disclose information:

\(a\) where required by law, subpoena, court order, or governmental request;

\(b\) to investigate fraud, security incidents, violations, or legal claims;

\(c\) in connection with a merger, financing, acquisition, restructuring, sale, or transfer of all or part of our business; or

4. Consumer Lead Information

IntroCart facilitates the purchase and delivery of consumer Leads.

Businesses purchasing Leads through IntroCart ("Buyers") act as independent data controllers and are independently and solely responsible for their subsequent processing, use, and disclosure of consumer information, including strict compliance with all applicable privacy, marketing, TCPA, telemarketing, and data-protection laws.

This Privacy Policy governs eQuoto's processing activities. It does not govern the independent privacy practices of a Buyer after consumer information has been delivered to that Buyer. Any account adjustments, disputes, or lead returns approved by eQuoto will be issued solely as account credits, and no cash refunds will be provided.

5. Cookies and Similar Technologies

We may use cookies and similar technologies for authentication, security, preferences, analytics, Platform functionality, and other permitted purposes.

Where required by applicable law, Users will be provided applicable choices concerning non-essential cookies or similar technologies.

6. Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including account administration, transactions, legal compliance, dispute resolution, fraud prevention, enforcement of agreements, and other legitimate business purposes.

Retention periods may vary depending upon the type of information and applicable legal requirements.

7. Data Security

We maintain reasonable administrative, technical, and organizational safeguards designed to protect personal information.

No electronic transmission or storage system can be guaranteed to be completely secure.

8. Privacy Rights

Depending upon where an individual resides and applicable law, that individual may have rights concerning personal information, including rights to request access, correction, deletion, or information concerning certain processing or disclosures.

We may take reasonable steps to verify the identity and authority of a person submitting a request.

We will not unlawfully discriminate against an individual for exercising applicable privacy rights.

9. Marketing Communications

Users may opt out of non-transactional marketing emails by using the unsubscribe mechanism included in the communication.

Account, security, transactional, contractual, and legally required communications may continue notwithstanding a marketing opt-out.

10. Children's Privacy

IntroCart is a business service and is not intended for children under eighteen (18). We do not knowingly permit individuals under eighteen to register for IntroCart accounts.

11. Third-Party Services

IntroCart may integrate with or link to third-party websites, payment processors, and services. Their privacy practices are governed by their own privacy policies.

12. Changes to this Privacy Policy

We may update this Privacy Policy periodically. We will update the “Last Updated” date and provide additional notice where required by applicable law.

14. Governing Law and Dispute Resolution

This Privacy Policy and any dispute arising out of or relating to it or IntroCart shall be governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles.

Any dispute, claim, or controversy arising out of or relating to this Privacy Policy, IntroCart, the Platform, or our processing of personal information will be subject to the dispute-resolution and mandatory binding arbitration provisions in the IntroCart Terms of Use, to the extent permitted by applicable law. Nothing in this provision limits any privacy right, remedy, complaint process, or other right that cannot lawfully be waived or required to be resolved through arbitration.
